According to the supreme court....
The term "woman" and "sex" in the 2010 equality act refers to biological women and biological sex.
Much like our American cousins we have come to the conclusion that sex is binary.
They found the Scottish government was wrong.
Well done for Women Scotland...a long battle but common sense is becoming fashionable again.

Holyrood in recess, do us a favour and make it permanent….
NHS Fife “considering” the ruling. How about considering their position and resigning? But only after reinstating nurse Peggie and telling the chap who got her suspended to get changed and apply his lippy in the men’s room?

Sex has always been binary - male or female. You`re thinking of gender. The court has essentially said that only people born female can be considered women (so sex = gender).
I`m pretty ignorant on this stuff so does this also mean male = man?

Nah that`s just silly bugger word games jake. Gender always was the same as sex until it was highjacked to mean something ethereal that could not be measured.
Godless people trying to create a new name for the soul.

Some of my female friends felt concerned that someone who was born a man could appear in the ladies toilets if they had now transitioned.
Given the ruling does that mean someone who was born a female but who has transitioned into male should go to the ladies toilets?
Despite all the fist pumping I`m not sure this moves us forward much. I suspect I`ll remain confused but just in a different box of the 4 box matrix.

Yes and no. Sex isn`t gender and gender isn`t sex but you`re right that until relatively recently it was assumed, as remains the case for probably 99.99% of people, that a male is a boy/man and a female is a girl/woman.

So why did the SNP government go down this path ? It wasn`t in any of their manifestos, but Independence was?

Probably to curry favour with the Greens and because it was a personal mission of a certain ex-FM.
Being honest, I`m not really clear how the decision today really resolves the issue of trying to incorporate multiple genders into a predominantly binary world. We now know that biological sex determines whether you`re a man or a woman, but does this mean, for example, a man living their life as a woman must use male facilities? Currently the decision on placing in a male or female prison is determined by the SPS doing an assessment (and not a decision by the FM as the media previously made out!). Will this now change and no assessment will occur? Doesn`t this raise a risk of a post-op trans woman being a potential target in a male prison?

To be honest, I`ve kept away from this subject because it`s been hard for me to understand what`s been going on.
My main gripe has been the abandonment of independence while this sort of policy has been going on.
Once again, the costs that this has cost along with the failed bottle bank project will horrify most folk.
Would think Fife NHS will pull the plug on their case......
We did this for you Beth....

Sorry, but I tend to ignore Tenruh`s posts now and this isn`t a subject I have strong opinions about anyway. From what I can gather the ruling seems to have raised more questions than it has answered.

There are nearly as many F2M transations now as there are M2F, so it`ll be interesting to see how folk respond when post-op trans men start trying to access women`s toilets like they are supposed to.
Or more masculine-looking cis women for that matter.
The enemy travels by private jet, not by dinghy.

That`s a good point Wotsit.
I think really it`s a pity it had to come to this. Five judges having to produce a mountain of paperwork to define what a woman is does seem a bit ridiculous. There did have to be a legal definition for single sex only places and for sports but people should always be treated with dignity and respect and allowances when possible should be made but it does have to take into consideration all reasonable viewpoints.
Ultimately I hope this starts to put this issue to bed as I`m fed up with far right nut jobs using this as a wedge issue. There are far more pressing concerns facing society than what the less than fraction of a percent of the population who identify as trans pose.
And although my eyes were open
They just might as well be closed

Sadly uk govt 1 Scots government 0 and rightly so. Perhaps the Scots now need to focus on important things like
Scot health - appalling
Scots violence - not good
Scots religious bigotry - appalling
Scots education - too complex and awful.
Scots over indulgent MPs - awful

Hate to be the fact checker but...
Health - better in Scotland
Violence - worse in England (and Wales)
Bigotry - worse in England (using religious hate crime as a measure)
Education - Depends which subjects you look at but I`d suggest Curriculum for Excellence is ***** and needs dropped.
Over indulgent MPs - Highest expenses claimant is English and 8 out of the top 10 biggest spenders are English.
So maybe give you 1 out of 5 there.
As has been highlighted, although it`s good to confirm that a biological sex determines if you`re a man or a woman, this simply raises further questions. Of course, it`s a nice distraction from things like economic failure, rising child poverty and public unrest.
