Spared jail because he pled guilty really. Club have come out and stated he will remain club captain.

Following the sentencing at Edinburgh Sheriff Court on January 28, 2026, Dunfermline Athletic CEO David Cook issued an official statement confirming that Kyle Benedictus will continue in his role as club captain.
​Summary of the Official Statement
​The club highlighted that they conducted a thorough internal investigation following the incident at Freddy`s Bar in March 2024. Key points from the statement include:
​Transparency: Cook noted that from the start, both Benedictus and teammate Sam Fisher (whose charges were dropped) were "open and honest with the club."
​The Incident: The club described the event as "regrettable" but noted that Benedictus became involved while "attempting to protect a team-mate." They also expressed well-wishes for the victim’s recovery

Sentence: 200 hours of unpaid work (Community Payback Order)

Charge: Assault to severe injury.

Mitigation: Previous good character, genuine remorse, and provocation.

Club Action: Retained as Club Captain.

The court also noted that while the injury (a broken neck bone) was severe, the fall was an "unfortunate" consequence of a scuffle rather than a premeditated attack, which contributed to him avoiding jail.

As much as I like Bene and the great job he did being capt.I think him staying capt sends out the wrong msg to young fans ,we have a number of players in the team who can take on the roll of captain,just look at who capt the last two games as an example

Bad circumstances and unfortunate injury suffered by the attacker - but is that not what you would expect your captain to do?

Can you imagine Norrie turning around and walking away if someone was attacking one of the youngsters in his team?

I just think this is sensible all round.

I think the previous hearing was in more detail, explaining the circumstances and timeline better.it was unfortunate that the agitator was injured in this way.

He has a sentence, which is appropriate, he was `sticking up` for a team mate from someone who was behaving badly.

It`s unfortunate that the guy was injured in this way, and that`s what the community service is for.

The club statement is decent, and as far as I know Bene has been a really good captain, he is always helping in community activities.

I`m not condoning violence, but the justice system has to have an element of redemption, and this is appropriate.

The world would be a lot better place, and folk would behave a lot nicer, if they were exposed to a punch in the puss as a teenager. One of the biggest lessons to be learnt comes in the form of a clenched fist, and very quickly teaches you to think before acting

I think its all speculation at the end of the day. The court assessed the circumstances and decided on the sentance. Bene will have to do his unpaid community service and we all move on.

Did so and got this again from the Daily Record -

During the struggle cowardly Wilkes is seen to approach Mr Dewar from behind and punch him to the ground, kick him to the head and attempting to stamp on him as he lay prone on the ground.

Wilkes is then seen to knock out barmaid Barbara Keszthelyi with a single punch to the face as she tries to break up the violent melee.
