I think it's because Fife council hold the lease and we are the 'tenants' - we want to get out of being the tenants, which FC will agree to, but GM (et al) won't. They want to become our landlords and hold us to the lease (which we can't afford).

Pretty sure in that instance, although we wouldnt be paying rent, the landlord is still entitled to chase the tenant for any costs relating to the condition of the property, should the lease state so. This seems to be the bigger issue rather than the actual payment of rent.

Cheers Honk - you've backed up my thinking a bit. Couldn't understand why he'd want the ground for anything other than houses. I'd imagine the council would be accommodating if they were getting their cash as well?

like I say Lorna I doubt its his money, his motive in this is to stop his pension fundbeing called in if this lease is ripped up.And he has obviously made promises to an investor friend to buy the license/lease to stop this happening and they can make money off it. Porobably through houses is the plan.
Thats the way I have picked it up from a few folk that have been pretty clued up thus far and from the other reports.

From what I've read I'm pretty confused.
Why is GM so keen to get the leasehold? From what I've read in the twitter feeds there is a loan of £2m to clear £1.5m of arrears on the lease.
The lease has a CVA estimated value of £143,226 or a GM value of £600k. Either way you are talking of forking out more to clear the arrears than the lease is worth?
Is GM worried that by making the request to release the leasehold that the council may call in the security on the lease against the pension fund? Has the council indicated they would do that?
Even if they did was the security not capped at £500k and it would be better to potentially loose that in a onner than fork out £1.5 to clear arrears and whatever else it costs for the remainder of the lease when the expected return by your own best figure is 600k (significantly more than anyone else thinks its worth!).

Hang on a second....having to break my dot net sabbatical to raise this but since when did holding a lease on something mean that you can do what you want with it? If Masterton manages to clear the debts and keep the lease with fife council then fife council are still the owners. Surely the conditions of the lease would not extend to Masterton selling it for the purpose of building houses. It wouldn't be his to sell!!

DrumRoad - I think the problem is that if the lease exists we as a tenant are committed to fulfil the terms of that lease which will cost money we do not have so doesn't matter where we train. Suspect those terms will relate to the condition it is maintained and ongoing rental.

I am not following what the problem is here at all, PU don't want Pitreavie, GM apparently does, don't see an issue.
UNLESS, he is claiming that he will lose his pension fund when Pitreavie is handed back to FC because the terms of the lease have not been met, regarding the maintenance and upkeep?
Simply a guess, not based on any facts.

Fife council own pitreavie and currently lease it to DAFC ltd (or some company) who in turn lease it to DAFC to use for training.
The only thing I can see, is that by him getting hold of the lease, he reckons he's going to get a fair bit of cash renting it to the pars. Maybe theres nothing in the contract about rent increases so he can charge us 10x what we are paying now?
Wonder if he'll accept a table at hospitality as a years payment.......

Pup - not unless we pay £25k to the farmer who owns it. This was the issue last season and I'm guessing is the reason Steelend no longer use it.
They had it on a long term lease with a former landowner who took a token rent of £1 per year. She sold up and the new guy demanded £25k or get orf his laaaand.

I think I will go with the above as we appear to have a willing "seller" in BDO & a willing "buyer" in FRC with regards Pitreavie lease.... So why not deal done!
I read stuff to do with GM pension funds tied in some way to Pitreavie & intertwined with The Pars Trust....... That's no the PST BTW.
I can't make sense of it but the scenario would explain why GM has put his head above the parapet once more.

For the record, Bank of Scotland at the time was solvent, they had attempted to buy Nat West but lost out to RBS and as such became a target for a predatory take over. With a view to avoiding this, they merged with the Halifax B.S. The merger took place in 2001 and Masterton retired in June 2001.

True main man was a bit harsh but a huge part of the "throw money at everyone" came from his (and others - particularly the two you mention) changes in policy after the Halifax merger.
Hornby was doing it on the retail side (to start) and Cummings was on the corporate from what I remeber.
The appointment of Crosby as head of the FSA was nothing short of a scandal seeing as how he was essentially placed in charge of overseeing complaints against his time at HBOS.
Funnily enough,nothing really happened.

Halifax never had a Corporate arm, Cummings was given free reign and the rest is history. Cummings was the only one ever fined over the whole disaster.

Pretty much all the banks were at fault for the collapse in 2007/2008. They interlinked so much debt amongst themselves that when the housing market crashed in the States, everyone was exposed to it (HSBC amongst the most at risk on the face of it) and inevitably they all suffered.
Whoever it was that suggested reading "The Big Short" I thank them a lot, it gives a really good insight into what happened.

In Scottish Law, the judge has to give a plaintiff or defendant permission for "leave to appeal"...... There is no automatic right of appeal in Scottish courts "without reasonable cause" ................ Or somit like that.

The happiest. He was singing Pars songs yesterday and when he saw the DAFC badge on the TV he was all exited. It broke my heart to think he might not get to go to the next 30 years worth of games like I just did with my Dad. I will tell him all about this day when he's older.

It's posts like this that sum why we're all sharing immense joy and relief, and why everyone in Pars United, and every supporter, has fought so hard for our club over the last year or so.
I'd have been heartbroken if things hadn't gone our way, especially as the Pars is the biggest single thing that bonds my dad and I - it was unthinkable to me that if in the future I have a family I couldn't share that with them either.
Thank you from the bottom of this Par's heart to Pars United and every single fan of Dunfermline Athletic. I've been to watch the team home and away with my old man for over 20 years - here's to the next 20 and beyond!
